LICENSED SITE REMEDIATION PROFESSIONAL (LSRP)

 

What is an LSRP and what is SRRA?

    Under N.J.S.A. 58:10C, the Site Remediation Reform Act (SRRA), signed into law on May 7, 2009 Licensed Site Remediation Professionals (LSRP’s), in most instances, will be responsible for the investigation and remediation of contaminated sites in New Jersey. This is a major change from the previous system of New Jersey Department of Environmental Protection (NJDEP) case management oversight and the issuance of No Further Action (NFA) letters to certify the completion of satisfactory remediation. Now LSRP’s will issue an “equivalent” document called a Response Action Outcome or RAO.

    Under SRRA, the LSRP has the authority and is required to implement remediation in accordance with N.J.A.C. 7:26C, the “new” Administrative Requirements for the Remediation of Contaminated Sites (ARRCS rules) and N.J.A.C. 7:26E, the Technical Requirements for Site Remediation (Tech Rules). Currently, LSRP’s who have satisfied certain NJDEP experience and competency requirements are certified as temporary-licensed LSRP’s. Upon completion of a 3 year phase-in period for the LSRP program and upon passing a rigorous examination, LSRP’s will be certified with permanent LSRP status.

 

When do I need to hire an LSRP?

    From May 7, 2009 to May 7, 2012 there is a phase-in/opt-in period for hiring an LSRP to conduct investigation and remediation of contaminated sites. Existing sites that have NJDEP oversight may opt-in to the LSRP program before May 7 2012, but as of that date, with a few exceptions, all remediation of contaminated sites in New Jersey will need to be conducted under the purview of an LSRP. The need to hire an LSRP and remediate a contaminated site is also triggered by the “affirmative obligation to remediate” provision of SRRA, which states that a responsible party must not wait for direction from the State, but must initiate necessary (cleanup) actions, including hiring an LSRP upon discovery of a discharge.
