NJDEP Announces Tool to Streamline Remediation

Exciting news for property developers and owners undergoing soil remediation which requires a NJDEP Remedial Action Permit for Soil!

On January 31, 2024, the New Jersey Department of Environmental Protection (NJDEP) introduced a handy tool to streamline your project: the Licensed Site Remediation Professional (LSRP) Supplemental Certification for Initial Soil Remedial Action Permit (RAP) Applications.

Here’s what you need to know:

  • Why It Matters: The LSRP self-certification option is a game-changer. With many New Jersey sites racing to meet remediation deadlines, this self-certification approach allows for quicker RAP approvals. This means getting to the finish line – a Response Action Outcome (RAO) – faster and more efficiently.
  • Speeding Up the Process: If you’ve already submitted a Soil RAP Application that made it through administrative review without any comment letters, this forms for you. It’s also applicable to new Initial Soil RAP applications, especially for less complicated sites not under direct oversight, and not related to landfills, schools, childcare centers, or residences.
  • Key Exceptions: The form isn’t suitable for sites needing special technical solutions, like caps for ecological protection, or remediation utilizing Alternative Remediation Standards (unless you received NJDEP pre-approval).
  • Looking Ahead: Keep an eye out for a similar LSRP Supplemental Certification for Initial Ground Water RAP Applications, also in the works by NJDEP.
