Update on NJDEP’s REAL Rule Changes for Coastal Flood Hazard Areas

Bayview - Resiliency Planning Landscape Architecture

On July 21, 2025, the New Jersey Department of Environmental Protection (NJDEP) filed a Notice of Substantial Change (NOSC) regarding the Resilient Environments and Landscapes (REAL) rules affecting New Jersey’s coastal flood hazard areas. This filing kicked off a new 60-day public comment period which will run until September 19, 2025, and includes a virtual public hearing on September 3 at 6:00 pm which Dresdner Robin will be attending.

According to NJDEP, there has been a shift in the scientific consensus surrounding sea level rise and changing coastal storms and flood risk. The new rule proposal includes a 180-day grace period between rule adoption and the date the new rules take effect.

If you are seeking assistance with the real-world impact of the new REAL rules on your project, please don’t hesitate to contact Matt Neuls, Associate Director of Land Development. We are here to guide you through every stage of the process with technical expertise and regulatory insight.
